The new Düsseldorf table for 2023

As of January 1, 2023, a new Düsseldorf table will apply. Here you can find all information about child support!

As of 01.01.2023, a new Düsseldorf table will apply.

Child support claims that are “dynamically” owed, i.e. whose amount is based on the currently valid Düsseldorf table, will increase from 01.01.2023.

The requirement rates for minor children are being raised, namely

  • for children of the first age group (up to the age of 6) to 437.00€ (increase of 41.00€),
  • for children of the 2nd age group (up to the age of 12) to 502.00€ (increase of 47.00€),
  • for children of the 3rd age group (from the age of 13 to the age of majority) to 588.00€ (increase of 55.00€).

These amounts correspond to the demand rates of the first income group (up to €1,900) in the Düsseldorf table. The increase in the demand rates of the 1st income group also results in a change in the demand rates of the following income groups. As in the past, they will be increased by 5% each from the 2nd to 5th groups and by 8% of the minimum maintenance in each of the following groups.

The requirement rates for adult children will also be increased as of 01.01.2023. As in 2022, they amount to 125% of the second-age group requirement rates.

The requirement rate of students who do not live with their parents or a parent will be increased from 860.00€ to 930.00€ compared to 2022.

In accordance with Section 1612b of the German Civil Code, the state child benefit is to be offset against the child's needs. From January 1, 2023, this amounts to €250.00 for all children.

The deductibles, which were last raised on January 1, 2020, will be increased as of January 1, 2023.

The necessary personal needs left to the person liable for maintenance are €1,120.00 (instead of the previous €960.00) for the non-working maintenance debtor and €1,370.00 for the employed maintenance debtor (instead of the previous €1,160.00).

The necessary deductible applies to maintenance claims according to the 1st income group of minor children and so-called privileged adult children up to the age of 21 who live in the household of their parents or a parent and are in general school education, Section 1603 (2) BGB.

The necessary excess includes accommodation costs (warm rent) of €520.00.

From January 1, 2023, the appropriate deductible against other claims for child support amounts to €1,650.00 (previously €1,400.00), Section 1603 (1) BGB.

The reasonable deductible of €1,650.00 includes housing costs of €650.00 (warm rent).

As of 01.01.2023, the spouse's own needs for claims amounts to €1,385.00 (previously €1,180.00), if the person liable for maintenance is in employment,

1,510.00€ (previously 1,280.00€). This includes housing costs of 580.00€ (warm rent).

From 01.01.2023, the minimum requirement of the spouse is €1,120.00, if employed, €1,370.00.

A) For maintenance creditors:

If you receive child support from the other parent, you should check whether you have received the correct increase from 01.01.2023 in contrast to the amount you have received so far.

If not, you should alert the maintenance debtor to the increase owed and ask him to pay back with reference to the new valid Düsseldorf table.

Excursus

Note that, in principle, you can ask the maintenance debtor to provide new information about his income situation at least every two years in order to check the correct amount of maintenance.

B) For maintenance debtors:

You may make an increase in child support from 01.01.2023 without request from the other parent. If there is an enforceable title (e.g. youth welfare certificate, court settlement, court order), this will prevent any other possible foreclosure against you.

Please note that you are generally entitled to a reduction in the amount of maintenance you may have

If your income on which the maintenance calculation is based has reduced or if the changes shown in the Düsseldorf table are in your favor.
